Fees of the Superior Court - Special Civil Part*

Collection suits are filed in the Superior Court of New Jersey. Cases involving claims of less than $15,000 are brought in the Special Civil Part of the Superior Court. Changes to the New Jersey Rules of Court increased the jurisdictional limit of the Special Part to $15,000 effective Sept. 3, 2002.

The Superior Court of New Jersey, Law Division has jurisdiction over claims for amounts greater than $15,000.

Filing and execution fees for cases filed in the Special Civil Part are considerably lower than those brought in the Law Division.
The tables below include selected filing fees and costs in New Jersey. Only those fees and costs most relevant to collection litigation appear in these tables. Pursuant to periodic legislation, certain filing fees are increased from time to time. This table is current through September 4, 2007.

In addition to the foregoing fees, the following fees for officers of the Special Civil Part shall be taxed in the costs and collected on execution, writ of attachment or order on any execution or attachment which may result in a payment for settlement of a judgment or attachment:

NOTE: These court officer fees are added ("taxed") to the amount due and owing from the judgment debtor.
